I have the honour to acknowledge the receipt

of your despatch No.62 of 21st February, 1928, transmitting

a copy of correspondence with Mr. J. Maxton, M.P., regarding

matters arising out of the Communist outbreak at Canton in

December last, and requesting to be furnished with a full

report of the points referred to in the correspondence.

I enclose a copy of a Police report which

shows that during the period 11th to 20th December, 1927,

two hundred and forty-six persons of Chinese nationality

were detained on arrival from Canton and of this number two

hundred and sixteen were sent away to destinations chosen

by themselves and thirty were released in Hong Kong. The

action taken by the Police was authorised by a Regulation

made under section 2 of the Emergency Regulations Ordinance,

1922, Ordinance No.5 of 1922 and published as Notification

No.397 in the Government Gazette of 6th July, 1925. A copy

Enclosure No.2 of this Regulation is enclosed.

The replies to Mr. Maxton's points so far as

they concern this Government are as follows:-

The extradition of Chinese from Hong Kong is

governed by the Chinese Extradition Ordinances,

1889 and 1927.

(2) These Ordinances do not permit of extradition for

political offences, and persons abusing the

hospitality of the Colony to conspire against the Chinese Authorities would not be arrested and hand ed

over to the Chinese Authorities but would be requir-

ed to leave the Colony.

The answer is in the negative.

No instructions were received from His Majesty's

Government in the matter.

nationality were detained and interrogated by

Hong Kong Police, on arrival from Canton during

the period 11th December 1927 to 20th December
